BEN WILFORD

CONSULTANT

Ben is a commercial disputes and regulatory lawyer with more than 16 years of experience advising on complex litigation, sensitive investigations and difficult legal problems at the intersection of law, risk, commerce and government.

Ben’s practice covers high-stakes commercial disputes, regulatory investigations and enforcement, internal investigations, employment and remuneration issues, risk and compliance, governance, administrative law, statutory interpretation and strategic commercial advisory work. He has acted across a broad range of sectors including financial services and fintech, construction, health, media, government, automotive, insurance and the not-for-profit sector.

Before joining Herman Legal, Ben was a partner in the Commercial and Government Litigation team at an international law firm. A distinctive feature of his practice is that, despite his disputes background, he was repeatedly sought out by clients to step into in-house legal leadership roles during periods of pressure and change. He acted as head of legal in Australia for PayPal (a major global digital payments platform), advising across regulator engagement, remediation, governance, product, employment, privacy, consumer issues and executive and board decision-making. He also acted as general counsel in a major NSW flood response context, advising on leasing, procurement, information access, operational decision-making and cross-functional delivery in a government crisis management environment.

That experience shapes the way Ben advises clients now. He does not look at a dispute or regulatory issue in isolation. He brings an in-house lens to the broader problem, including governance, reputational risk, regulator strategy, commercial priorities, operational constraints and the decision-making needs of boards and executive teams.

Ben is particularly well suited to sophisticated commercial clients, scaling businesses without in-house counsel, not-for-profits and general counsel seeking lean, high-quality external support. He combines the standards and strategic discipline of top-tier disputes practice with practical business judgment and careful use of legal technology to deliver advice that is precise, efficient and useful in the real world.
